Ujaala Real Estate operates exclusively as an independent digital discovery and advertising medium. Ujaala Real Estate is NOT a registered promoter, real estate agent, or broker regulated under the Real Estate (Regulation and Development) Act (RERA). We do not act as an escrow agent, broker of record, or contractual party to any real estate purchase, sale, lease, or financial transaction.
1. Acceptance of Terms
By accessing or using the Ujaala Real Estate website, mobile application, or direct telephone services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please discontinue using the platform immediately.
2. Scope of Service & Pure Discovery Model
Ujaala Real Estate provides an informational property discovery feed, detailed specification overviews, photographs, and direct telephone call connectivity ('Call-Now') for real estate in Delhi NCR. We do not process property purchases, rent transactions, payment escrows, or title transfers directly through the website.
3. User Responsibility & Due Diligence
Prospective buyers, sellers, and tenants are solely responsible for conducting comprehensive independent legal and physical due diligence before executing any property agreement. This includes but is not limited to:
- Verifying title deeds, ownership registry, mutations, and non-encumbrance certificates.
- Inspecting sanction plans, floor area ratios (FAR), and municipal compliance (MCD/DDA/Town Planning approvals).
- Confirming physical measurements, carpet area, super area, and physical possession.
- Ensuring statutory tax deductions, stamp duty payments, and registration compliance.
4. Accuracy of Listing Data & Photography
While Ujaala Real Estate strives to curate high quality and verified listings, all dimensions (sq.ft, sq.yards, gaj), pricing, amenities, and photographs are provided on an "as is" and "as available" basis without express or implied warranties. Prices and availability are subject to change without prior notice by property owners.
5. Direct Communications & Telephone Connectivity
When you tap 'Call-Now' or contact Ujaala Real Estate, you consent to receive direct telephone calls, WhatsApp communications, and SMS updates regarding your requested property inquiries. We do not sell your contact details to third-party telemarketers.
6. Limitation of Liability
To the maximum extent permitted under applicable law, Ujaala Real Estate, its directors, developers, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from:
- Any real estate transaction, negotiation dispute, or contractual default between buyer and seller.
- Inaccuracies or typographical errors in property listings or prices.
- Temporary service interruptions or network downtime.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with the platform shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
